This website is operated by TY Creations LLC, doing business as Warfighter Markers ("Warfighter Markers," "we," "us," or "our"). By visiting our website and/or purchasing from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our website or services.

1. Eligibility

By using this website or placing an order, you represent that you are at least 18 years old or the age of majority in your state or jurisdiction of residence.

2. Products and Services

Warfighter Markers offers custom-crafted engraved wood markers and related products and services. Because many of our products are made to order, variations in wood grain, engraving contrast, finish, and natural material appearance are normal and are not considered defects.

We reserve the right to modify, discontinue, limit, or refuse any product, service, or order at any time for any reason.

3. Accuracy of Information

You agree to provide current, complete, and accurate information when placing an order or using our services. This includes, but is not limited to:

  • engraving text
  • spelling
  • capitalization/lowercase preferences
  • uploaded logos or artwork
  • shipping address
  • website URLs
  • QR code destinations
  • Connect Profile or business/contact details

Warfighter Markers is not responsible for customer-submitted errors after proof approval or, where no proof is provided, after order submission.

4. Custom Orders and Proof Approval

Many custom orders include a proof approval process prior to production. Proofs are typically sent within 48 hours of order submission, though this may vary based on order volume, design complexity, weekends, holidays, or incomplete customer information.

Production does not begin until proof approval is received.

For custom orders requiring proof approval:

  • production and engraving typically begin only after final proof approval
  • production timelines are generally 3 to 5 business days after proof approval
  • delays in proof approval will delay production and shipping timelines
  • reasonable revisions are included prior to final approval

Once a customer approves a proof, Warfighter Markers is not responsible for approved errors, including but not limited to spelling, formatting, capitalization, artwork placement, layout, QR code destination, URL errors, profile details, or other customer-approved content.

5. Customer-Submitted Content and Intellectual Property

By submitting any artwork, logos, images, text, branding, or other content to Warfighter Markers, you represent and warrant that:

  • you own the content or have all necessary rights, permissions, or licenses to use it
  • your submitted content does not infringe on any third-party intellectual property, privacy, publicity, or other legal rights
  • your submitted content does not violate any law or regulation

You agree that Warfighter Markers shall not be liable for any claims, damages, losses, or legal disputes arising from customer-submitted content.

We reserve the right to reject or cancel any order that includes content we believe may infringe on rights, violate law, or create legal or reputational risk.

6. Product Use and Limitations

Our products are intended for lawful and appropriate use only. You may not use our products, services, website, or custom design process for any unlawful, harmful, misleading, infringing, or unauthorized purpose.

7. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to update pricing, product offerings, shipping rates, fees, and product descriptions at any time without prior notice.

Orders will not be processed until payment is successfully received.

8. Shipping and Delivery

Shipping timelines, production estimates, and delivery estimates are provided in good faith but are not guaranteed unless expressly stated otherwise.

Warfighter Markers is not responsible for delays caused by carriers, weather, holidays, supply issues, incorrect customer-provided information, or other events outside our control.

9. Refunds, Returns, and Replacements

Because many of our products are custom-made, all sales are generally final except in cases of verified defect, production error, or order issue caused by Warfighter Markers.

We reserve the right to determine the appropriate remedy, which may include replacement, store credit, or refund, at our sole discretion.

10. Connect Series, QR Codes, and Digital/Profile Functionality

Certain products or services may include QR code functionality, profile pages, digital links, or related web-based features.

Customers are responsible for ensuring the accuracy of submitted URLs, destination links, profile details, contact information, and other digital content.

QR code destinations may be shown during proofing for customer verification prior to production.

Warfighter Markers is not liable for issues caused by:

  • customer-submitted incorrect or outdated links or information
  • third-party website changes or downtime
  • Shopify, Wix, hosting, browser, device, app, email, or social platform issues
  • future customer edits, removals, or changes to linked content

11. Wholesale Orders

Wholesale, bulk, pro shop, or business-related orders may be subject to additional review, pricing, approval, lead times, or separate terms at our discretion.

12. Disclaimer of Warranties

To the fullest extent permitted by law, our products, website, and services are provided "as is" and "as available" without warranties of any kind, express or implied, except where otherwise required by law.

13. Limitation of Liability

To the fullest extent permitted by law, TY Creations LLC dba Warfighter Markers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our website, services, or products.

Our total liability for any claim relating to a product or order shall not exceed the amount paid for that specific order.

14. Indemnification

You agree to indemnify, defend, and hold harmless TY Creations LLC dba Warfighter Markers from any claim, liability, damage, loss, or expense arising out of your submitted content, misuse of our services, violation of these Terms, or infringement of any rights.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date.
